Women are sometimes paid less than men for doing the same job, or which requires the same level of skill, knowledge, effort and responsibility. As an employee you have a right to equal pay regardless of your type of contract, including bonuses, overtime, holiday pay, sick pay, performance related pay and occupational pensions.

If you are a woman and you are appointed a lower rate of pay than a male colleague for doing similar work or a man receives a bonus or pay rise which you do not get because you are on maternity leave, you realise that you have a different job title or grade, you find that you have no entitlement to sick pay, holiday pay or pension benefits because you are a part time worker, you are being paid less per hour than a man doing the same work full time, or your employer puts you and your colleagues on individual contracts and tells you not to discuss your salary or employment details, then you are in a situation that is vulnerable to sex discrimination.

As a first stage you need to take your evidence to your manager or your employer and explain that you are being paid or treated unfairly compared to a colleague of the opposite sex, creating a gender gap. There may be a good reason for the pay difference but if you are not happy you need to take your complaint to an employment tribunal. To prove that your sex, whether you are a man or a woman, is the discriminating factor in law you need to demonstrate to a court that someone in your company is getting paid more than you in the same job and are of the opposite sex. You will need to think about your job role, your job title and description, your qualifications, whether they are o’level, gcse, A’level diploma or degree, your length of service, hours of work and level of pay.
